Court order on compensation

KSRM pays Tk 4 lakh to family for child labour’s death

STAFF REPORTER, Ctg
KSRM pays Tk 4 lakh to family
for child labour’s death

The authorities of Kabir Steel Re-rolling Mills (KSRM), one of the country’s leading steel manufacturing companies, paid compensation for the death of a child labourer before the Chittagong labour court on Wednesday. The death occurred in an accident at the KSRM's Khaja Ship Breaking Company at Sitakunda in Chittagong last May.

On Monday, the Chittagong labour court summoned three persons of the KSRM, including its owner Shahjan Kabir, for delaying to pay compensation in response to the plea of the victim’s mother, Alo Rani Das. The chairman of the labour court, Moktar Ahmed, issued a summons and ordered them to physically appear before the court on December 12.

The authorities appeared before the court and submitted Tk. 4 lakh yesterday.  The court then disposed of the case, said advocate Sukhmoy Chakraborty, the plaintiff's lawyer. “The district crisis committee has fixed the compensation to be paid for on-duty labour death at Tk. 5 lakh. It was Tk. 1 lakh earlier. This is the first case in which the owner had to pay Tk. 5 lakh,” added the lawyer.

Earlier, the court summoned Shajan Kabir, managing director of the KSRM and Khaja Ship Breaking Company (Kabir Steel), general manager Sayed Nazrul Alam and yard manager Md Mafiz.

The plaintiff's lawyer said: “The court issued summons against the three persons. On May 21, a worker, Sachindra Das, 16, had died in an accident at the Khaja Ship Breaking yard at Sitakunda. As the owner did not pay the compensation, the case was filed.” As per the case statement, the victim’s family was to get Tk. 5 lakh as compensation, but the owner paid only Tk. 1 lakh.

The victim’s family filed a complaint with the deputy director of the Ministry of Labour and Employment and sought rest of the amount.  Despite a reminder, the owner did not pay Tk. 4 lakh.  On November 9, 2017, Alo Rani Das filed the case before the labour court.

Mohammad Ali Shahain, an official of Young Power in Social Action (YPSA) working for the rights of ship-breaking yard workers, said the district crisis committee, led by the Chittagong district deputy commissioner, had fixed the compensation at Tk. 5 lakh for the death of any  worker in accident. “We urge all owners of the ship-breaking yard to follow the rules of the district crisis committee,” he added.
