Victim’s brother denied bail

The district and sessions judge court yesterday denied bail to Tasfiq Uddin Sabur, 14, who has been falsely accused of raping his younger sister at Rangunia in Chittagong district.
Chittagong District and Sessions Judge Nurul Huda rejected the bail petiton of Sabur, who was sent to jail on May 10 on charge of raping his younger sister. The victim later retracted her statement, saying she was forced to accuse her own brother instead of the real culprit.  
Advocate Ershadur Rahman, a panel lawyer of Bangladesh Manobadhikar Bastabayan Sanstha, argued on behalf of Sabur, claiming that the boy was falsely implicated in the case by police. He added that after publication of the real incident in the English daily, The Independent, a lawyer had filed a writ petition with the High Court. Following a HC directive, police have already arrested the main suspect, Shah Alam, he added.  
Moreover, the sister has already applied to the court to withdraw the case against her brother, the defence lawyer said. She has also filed a case against the alleged rapist, Shah Alam, he added.
Rahman also informed the court that the victim had also appeared before the court to withdraw her earlier deposition, and she pleaded with the court to grant her brother bail, considering the real facts.  “However, the court did not grant the bail as police could not submit its report yet,” the lawyer said.
Earlier, Nur Jahan Begum, the victim’s mother, appeared before the court of senior judicial magistrate Qudrat-e-Elahi on June 8 and applied to withdraw the case. Later, the girl herself appeared before the same court on June 14 and submitted an application to withdraw her deposition, which she was forced to give under duress to the magistrate.
