case seeking cancellation of results

Tabith Awal, BNP’s mayoral candidate for Dhaka North City Corporation (DNCC), filed a case with Dhaka’s Joint District Judge Court yesterday seeking cancellation of the results of DNCC election held on February 01.

Judge Utpal Bhattacharya of the election tribunal accepted the suit and a date of hearing would be fixed after collecting all documents and records in this regard, Barrister Ehsanur Rahman, one of the counsels for the petitioner, told The Independent after filing of the petition.

In response to a query, the lawyer said, as per the election law any aggrieved candidate can file a case seeking cancellation of the elections results, if any irregularities had taken place during the polling.

According to the case statement, petitioner Tabith claimed that the February 1 election was held amid irregularities and corruption, adding that on that day, a satisfactory number of voters did not turn up to cast their votes.

The petitioner also alleged that the election commissioner, in collusion with others, declared M Atiqul Islam the mayor of DNCC amid irregularities and corruption.

The chief election commissioner, commission’s secretary, winner candidate M Atiqul Islam and five others have been made defendants to contest the suit. The newly-elected mayors and councillors of DNCC and Dhaka South City Corporation (DSCC) took oath of office on February 27.

Elections to the DNCC and DSCC were held on February 1 and Awami League mayoral candidates M Atiqul Islam and Sheikh Fazle Noor Taposh won respectively.

A gazette notification was issued on February 4 naming Atiqul and Taposh as the elected mayors of DNCC and DSCC.
