A High Court bench, yesterday, commented that children of all divorced families face the same difficulties as Dhruba and Lubdha, who got the opportunity to place their opinion before the court that created a highly emotional scene in the courtroom on June 25. The reaction of the two children reflected the difficulties faced by thousands of children across the country, the bench noted.

The HC bench comprising Justice JBM Hassan and Justice Khairul Alam came up with the comment while it was hearing on the petition related to the development of the relationship between the parents of Salim Sadman Dhruba, 12, and Lubdha, 9.

Following a prayer made by the two children, the same bench of the HC had, on June 25, asked their parents to consider the interests of their children and adjourned the hearing on a petition filed by Kamrun Nahar Mallika, mother of the two children, who was divorced by her husband one year back.

On June 25, the HC bench gave time to the parent of the children till yesterday to develop their relationship and asked the lawyers of both the sides to inform the court about the development of their relationship.

During yesterday’s hearing, the HC bench asked the lawyers whether there is any development between the husband and wife.

Barrister Ruhul Kuddus Kajal, counsel for the mother of the

children, and advocate Taposh Kanti Das, counsel for the father of the children, told the court that some development had taken place and it would take some time for the development of good relations between the husband and wife, as it is a family issue.

The court said that this is not an isolated story of difficulties faced by children stuck in the middle of parental divorce. There are many children across the country who faced similar difficulties. But, the two children got opportunity to place their prayer before the court while others do not get the opportunity to place their prayer though they face tremendous difficulties due to the divorce of their parents, the HC bench added.

The parent of two children considered their children’s interest, but many other parents did not pay any heed to the prayer of their children, the HC bench said. At one stage of the hearing, the HC bench also said that the people of the country are waiting to see the decision of the parents of these two children.

“Both of you are educated and received highest degree. So, people of the country are waiting for your decision,” the HC bench told the parents. Later, the HC bench fixed August 1 as the date for next hearing over the matter.

Kamrun Nahar Mallika, mother of the two children, who was divorced by her husband one year ago, filed a writ the petition before the HC seeking guardianship of the two boys, as her husband, Mehedi Hasan, had sent them to their grandfather’s home in Magura district before giving divorce to her on May 12 last year.

Following the HC order, police produced the two children before the court on June 25 and heard the opinions of the two children where the two boys told the court that they did not seek anything except their parent together. The two boys made the appeal before the court while Mallika went to her child and hugged the boys only to break down in tears. The children, too, wept in the arms of their mother and asked their father to come to their mother.

At one stage, the courtroom witnessed a heart-wrenching scene when their father came to their mother—all of them broke into tears. There was not a dry eye inside the courtroom at that moment.

After some time, the senior judge of the court asked their mother to consider the interests of their children. All the lawyers also asked their parents to reconcile for the sake of the children.
