Loopholes in the public exam act

Given the higher frequency of question paper leakages in recent times, amending the flawed Act is more than just important

The fact that question papers of various exams are being frequently leaked because of the existing loopholes in the Public Examination Act-1983 is not a new revealation. The Act does not have any specific provision for punishing offenders involved with leakages, and yet the Act exists. Legal experts often suggested for the inclusion of a specific provision for offenders, and now it’s time to ask for a clearer explanation why the provision is not being included?
Compared to the importance of the Public Examination Act, at least a couple of dozens of lesser important laws and Acts have been modified and changed in Bangladesh. Are we to believe, that our lawmakers are purportedly protecting the syndicate responsible for leaking question papers? Whatever the reason may be, public exams in Bangladesh are often being riddled with corrupt practices, and disclosing of question papers via illegal means is one of them. Many meritorious and deserving candidates are being deprived of attaining important posts.  
Reportedly a large number of influential government employees are engaged in leaking question papers in Bangladesh. Rather, there has been a syndicate which is very much active in leaking question papers before the exams. Unquestionably, they have a strong underhand link with government officials and the politicians by which they are committing such a crime. This syndicate remains unapproachable. During the police investigations only their accomplices are held and punished only by name. Furthermore, there is an evident lack of confidentiality among the organizations and the Bangladesh Government Press. People working in these places are reportedly misusing their administrative power for personal interest.
Given the higher frequency of question paper leakages in recent times, amending the flawed Act is more than just important. Moreover, passing of an amended law without its effective implementation is needless as well. For instance, following allegations of question paper leak, the High Court, on last May, had imposed restrictions for three months on publishing the results of the written test for the post of senior officer of Janata Bank and its further proceedings. It also issued a rule asking the authorities to explain why their inaction to investigate the allegation of question paper leak and cancel the tests should not be declared illegal. This type of crime is recurring for many years now and cannot be stopped mainly due to the absence of stricter provisions of law for deterring leakage offences. 
We expect the relevant stakeholders, including the ministries for law and education, to jointly work out to produce an effective law for stopping  the scamsters.
