Moudud moves HC to get back Gulshan house

Senior BNP leader Moudud Ahmed yesterday filed a writ petition in the High Court (HC), challenging the legality of his eviction from his Gulshan residence. After brief hearing on the petition, an HC bench, comprising Justice Syed Muhammad Dastagir Husain and Justice Md Ataur Rahman Khan, adjourned till July 2 the hearing on the petition.
Barrister Moudud Ahmed filed the petition yesterday morning, seeking a directive to the government against effecting any change in the character and nature of the plot of his Gulshan residence.
The petition also sought an HC order on the authorities concerned to give him back the possession of the house. It challenged the legality of the eviction drive by the Rajdhahi Unnayan Kartripakkha (Rajuk), which did not serve any prior notice to Moudad.
During yesterday’s proceeding, advocate AJ Mohammad Ali and Supreme Court Bar Association (SCBA) president advocate Joynul Abedin appeared for Moudud. Attorney general Mahbubey Alam represented the state. The court asked the petitioner whether he wanted an order or a rule.
“If you want an order, we’ll hear from both parties,” the court said. But the HC bench adjourned the hearing after the state’s chief law officer opposed the petition.
Moudud was yesterday evicted from his residence of three decades after he lost a legal battle over the ownership of the house, worth Tk 300 crore, in the capital’s Gulshan area. RAJUK took over Moudud Ahmed’s Gulshan house following an apex court order.
All utility services like gas, water and electricity supply to the house were disconnected, while its valuables and furniture were removed.
On June 4, the Appellate Division of the Supreme Court (SC) dismissed two petitions seeking a review of the SC verdict that had scrapped Moudud’s possession of the house at Holding No 159 in Gulshan-2 area. One of the review petitions was filed by Moudud’s brother Manjur Ahmed and another by the Anti-Corruption Commission.
The SC had released the full text of its verdict against Moudud’s possession of the house on August 2, 2016.
Later, Moudud filed a review petition, but the apex court rejected his plea on June 4.
