Hand Book on Code of Civil Procedure (1st edition, 2015) is an innovative new book by Mahamud Wazed, a lawyer who practises at the Judge Court in Dhaka.
A good number of books have already been written on the subject. Then one may ask: What is the necessity of this book?
The book, published by Hira Publications, Bangladesh, is a text as well as a reference book for tertiary-level students, teachers and persons who are engaged in the legal profession. The book has a distinguishing feature which makes it unique from others.
The subject of law of civil procedure is widely taught in all law departments of universities throughout the country. But students generally do not follow foreign writers because of complexity. It is also noteworthy that this subject is practised as a procedural law in the court arena; hence some writers merely target the practitioners, such as lawyers and judges, excluding law students and general readers. Wazed attempts to explain the civil law lucidly and clearly, which would be helpful to the general students and readers alike.
The 702-page book comprises of 33 chapters. All the chapters elaborate on critical procedural matters, along with providing relevant sections giving easy examples and illustrating case references. After discussing the civil procedure, the author also describes the constitutional remedies in a civil suit, some important provisions of the Court Fees Act, 1870, the Suit Valuation Act, 1887, the Stamp Act, 1899, and the Specific Relief Act, 1877, which are also part of the civil suit.
The last chapter of the book mentions basic rules regarding ‘khatian’, meaning the record of rights, which is also a part of the civil suit, and shares prolific knowledge of the concerned parties to a suit.
At the end of the book, the writer includes the legislation, The Code of Civil Procedure, 1908, and all the schedules of the code are provided as well. The appendixes are arranged chronologically.
In spite of having so many good things, the book still has a few limitations, such as typing mistakes or spelling errors, some footnotes are not found in proper places, while some chapters (9, 13, 16, 19, 24, 25, and 28) are short and could have been elaborated. Hopefully, the author will make necessary changes in the second edition of the book, which is due to be published soon.
Except the minor mistakes, overall the book contributes nicely with respect to civil jurisprudence. Compared to other law books available in the market, the Handbook on Code of Civil Procedure is encouraging.
