The International Crimes Tribunal (ICT) yesterday sentenced two Razakars commanders from Kishoreganj to death for their monstrous crimes against humanity in 1971, reports BSS.
“Moslem Prodhan and Syed Md Hussain alias Hossain are held guilty . . . and sentenced unanimously to death,” said Justice Anwarul Haque, chairman of the three-member panel of the ICT-1.
Of the two, only Prodhan faced the trial in person and was present at the courtroom as the verdict was pronounced while Hussain earlier went into hiding as the process was launched to expose him to justice and believed to be in Malaysia.
The tribunal in its 563-page verdict found the duo guilty by majority in all the six charges and sentenced them to death unanimously in charge number three and four.
Prodhan and Hussain were convicted and sentenced unanimously to death for charge number three, which suggested them to have killed 26 people in village Gurui under Nikli Police Station in Kishoreganj.
Hussain was sentenced to seven years rigorous imprisonment for charge number one. He was convicted by majority in charge number two and was sentenced to five-year rigorous imprisonment. Hussain was held guilty by majority for genocide and was held guilty by minority for abduction, confinement, torture and rape in charge number four and was unanimously sentenced to death.
Prodhan and Hussain were convicted and sentenced to imprisonment for “rest of their natural life” for charge number five.
Hussain was convicted by majority of the panel for “other inhuman acts” as he mutilated the bodies of martyr Freedom Fighters Khairul Jahan and Selim.
According to the charge the two freedom fighters’ bodies were tied up with an army jeep which dragged them on the rugged roads to be mutilated.
Hussain was unanimously sentenced to 10-year rigorous imprisonment for this inhumane act.
“The sentence of death awarded as above be executed by hanging the convicts by the neck or by shooting till their death, as decided by the government,” the verdict said.
It added: “However, as and when any sentence of death awarded to convicts Md Moslem Prodhan, and Syed Md Hussain alias Hossain as above will be executed, the other sentence of death and sentence of imprisonment awarded to them as above would naturally get merged into the sentence of death executed.”
Prosecutor Tureen Afroz expressed her happiness at the judgment. Defence counsel Abdus Sattar Palowan, however, expressed his disappointment over the verdict, saying his client was likely to file appeal.
Earlier on March 7, the ICT-1 had kept the judgement on CAV, saying it would pronounce any day the verdict against Hussain and Prodhan.
The tribunal had passed that order as it wrapped up the hearing of the case on that day. During the hearing, advocate Abdus Sattar Palwan argued for the acquittal of the duo.
Senior prosecutor Tureen Afroz, however, summed up her rebuttal by pleading capital punishment for the duo, saying the defence has not been able to cast any doubt on prosecution case thus the case of the prosecution stands firmly.
According to the prosecution, Prodhan was the Razakar commander of the then Nikli union, while Hossain was the commander of Nikli thana.
The prosecution on December 3, 2015, submitted formal charge in the case, pressing six charges of the crimes against humanity against the accused. The ICT-1 on January 7, 2016, took the charges into cognizance and indicted the duo on May 9, 2016.
The prosecution on June 5, 2016, submitted the opening statement, initiating the hearing of the case formally.
