SC upholds HC order rejecting Khaleda plea

By dismissing a petition the Appellate Division of the Supreme Court yesterday paved the way for the concerned trial court to continue the proceedings of Zia Charitable Trust corruption case against BNP Chairperson Khaleda Zia. A three-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha dismissed an appeal filed by Khaleda challenging a High Court order that had on January 12 rejected her revision petition seeking a stay on the trial proceedings in Zia Charitable Trust graft case. Later, Barrister AM Mahbub Uddin Khokon, counsel for Khaleda, told reporters that Khaleda would move a petition before the Appellate Division seeking review of its order after getting the copy of its dismissal order.
Khaleda filed the revision petition on December 6 after another bench of the High Court rejected her plea to halt  the case proceedings and record afresh the testimonies of the 32 witnesses.
The trial in the case over illegal transaction of nearly Tk 31.55 million is under way at Dhaka’s Third Special Judge’s Court set up in Dhaka’s Bakshibazar.
There is no legal bar for the trial court to continue the proceedings against Khaleda in the case following the apex court order, Anti-Corruption Commission lawyer Advocate Khurshid Alam Khan said. On August 8, 2011, the ACC filed the Zia Charitable Trust graft case with Tejgaon Police Station accusing four people, including Khaleda, of raising funds for the trust from unknown sources abusing power. The others accused in the case are Khaleda’s former political secretary Harris Chowdhury, his former personal assistant Ziaul Islam Munna, who is now the acting director (naval security and traffic) of BIWTA, and former Dhaka City mayor Sadeque Hossain Khoka’s personal assistant Monirul Islam Khan. Harris has been absconding since the case was started while Munna and Monirul have submitted statements in their defence to the court.
