Tribunal asks Zafrullah Chy to explain position

Comment on ICT judges

International Crimes Tribunal (ICT) yesterday asked Gonoshasthaya Kendra founder Zafrullah Chowdhury to explain his position over his comments regarding the tribunal judges.

The tribunal asked Zafrullah to explain why a contempt of court proceeding should not be initiated against him for his comments over the tribunal judges.
After hearing on a petition, a three-member ICT-2 bench led by Justice Obaidul Hassan asked Zafrullah to appear before it on July 22.
This is the third time the Gonoshasthaya Kendra founder has been implicated for his comments regarding the tribunal. On July 6, freedom fighters Monoranjan Ghoshal, Ali Asgar, and Nazrul Islam, Kamal Pasha Chowdhury, organiser of a Ganajagaran Mancha faction, and one FM Shahin, jointly filed a petition seeking to implicate Zafrullah and try him for contempt over his comments on the ICT judges.

Advocate Khan Mohammad Shamim Aziz, counsel for the petitioners, told the court that Zafrullah has made a derogatory remark on the tribunal judges. Azizi also submitted a CD that contained Zafrullah’s comments to the media and also read them aloud at court.
“Today's contempt of court verdict is the proof of mental sickness of the three judges. It proves mental illness of the three justices. Ensuring justice is not possible if the judges can't tolerate criticism. When they can't tolerate criticism and lack rationality, they hide themselves under the cover of law,” reads a portion of his comments.
“We want his exemplary punishment for his comments on the judges,” Aziz added.
Later, the ICT-2 fixed July 22 for delivering its order over the matter.
On June 10, the ICT-2 found Zafruallah guilty of contempt of court for criticising the punishment of British-origin journalist David Bergman and punished him keeping him standing in the court for an hour and fined him Tk 5,000.
The court also asked him to pay the fine in seven days and in default of which he would have to suffer one month in jail.
On June 16, the Appellate Division's Chamber Judge withheld the judgment of the ICT-2 for fining Dr Zafrullah for contempt of court after hearing a petition by him against the ICT-2 judgment. But the tribunal did not get the copy of the order on the deadline (June 17).
Later, he said the verdict by the ICT-2 stems from ‘ mental illness’ of the three judges, whose orders to hang war criminals Abdul Quader Molla and Mohammad Kamaruzzaman have been executed.
