Education ministry has issued a show-cause notice against an official of University Grants Commission (UGC) for favouring a private university by violating the directives of the High Court (HC) and the ministry.
The show-cause notice said that Senior Assistant Secretary (legal) Mauli Azad favoured a group of the IBAIS University and uploaded the address of the Dhanmondi group on the commission’s website by violating the writ petition.
She has misinterpreted the stay order of the high court writ petition no: 12017/2016, the ministry said in the show-cause notice on November 30.
The court directed not to use the address of the university on the commission’s website as there is conflict of ownership about the university. But she has used the address after being partial to the Dhanmondi group, which is the sheer violation of the HC writ petition and the law. The ministry has given letter to the UGC chairman to take legal steps against her. But she denied the allegation and shouldered the responsibility on other officials of the commission. “As I’m an official of the legal division of the commission, the ministry has issued a show-cause. I don’t know anything about it. Other officials have done it. I have informed it to the ministry,” Mauli Azad said. Officials of the education ministry said the IBAIS University has a case in the court for a long time over its ownership between Dhanmondi Group (Shawkat Aziz) and Uttara Group (Zakaria Linkon).
The ministry on June 28 sent a letter to the UGC not to display the address of the university on its website and to remove it. Later, the High Court gave a directive not to use the address of the university on the commission’s website. But the concerned officials of the UGC have given a favour to the Dhanmondi group by misinterpreting the writ and used the address on its website.
The Uttara Group (Zakaria Linkon) filed a writ petition no 5167/16 with the High Court this year. The court then gave directives to the UGC to carry out all official work with the university (Uttara Group) and also said why the address (House 16, Road 5, Sector 4, Uttara) of IBAIS University would not be used on the UGC website. Then the Dhanmondi group filed a writ (12017/16) against it. The court then gave a stay order for six months against the activities of education ministry and the UGC. But Mauli Azad misinterpreted the writ petition and gave note to use the address of the Dhanmondi group on its website.
There are allegations that the legal aid division of the UGC is showing leniency in conducting cases against different universities over the conflicts of ownership, trustee board, and appointment of vice-chancellors. As a result such cases are pending in the court years after years.
