An appeal was filed with the Supreme Court against a High Court order that had directed the trial court concerned to conclude the radar graft case against Jatiya Party Chairman and former President HM Ershad and three others by March 31, 2017.
Advocate on record Syed Mahbubur Rahman filed the leave-to-appeal with the Appellate Division of the Supreme Court on behalf of former Air Chief Sultan Mahmud, also an accused in the case, seeking a stay on the HC order.
In his appeal, the appellant said that the HC passed the order without hearing his arguments. Anti-Corruption Commission (ACC) lawyer Khurshid Alam Khan told reporters that the chamber judge of the apex court may hold hearing on the appeal today (Tuesday).
In response to an appeal filed by ACC, the HC on November 24, directed the trial court to finish the trial proceedings of the case by March 31 next year.
The lower court concerned can record statements of the case's remaining 26 prosecution witnesses if they are produced by this period, the HC bench of Justice M Enayetur Rahim and Justice JBM Hassan said in the order.
Now-defunct Bureau of Anti-Corruption filed the case against former military ruler Ershad and four others with Cantonment Police Station on May 4, 1992.
