The High Court (HC) will deliver its order today on the Anti-corruption Commission’s (ACC's) plea in a case lodged over alleged corruption by former president HM Ershad in purchasing radars for the Air Force during his tenure.
After concluding the hearing on the petition, the HC bench of Justices M Enayetur Rahim and JBM Hassan fixed the date for delivering its judgment.
The ACC moved the HC as a lower court on November 8 dismissed its plea to record the depositions of the witnesses afresh, who had not given their deposition at the trial court.
ACC lawyer Advocate Khurshid Alam Khan told this correspondent that the trial court had recorded the statements of only 12 witnesses out of 38 witnesses in the case. The ACC had filed an application before the trial court, seeking its order to produce the other 26 witnesses so that they can give their fresh deposition in connection with the case.
“However, the lower court dismissed our petition. Hence, we moved the HC, challenging the trial court verdict and seeking its permission to produce the other 26 witnesses before the lower court. After concluding the hearing, the HC bench decided to pronounce the verdict on Thursday,” Khan added.
The now-defunct Anti-corruption Bureau on May 4, 1992, had filed the case against the Jatiya Party leader for causing a loss of more than Tk. 64 crore to the state exchequer by buying substandard radars from the US with higher prices instead of buying a more modern version from France.
The charge-sheet was given in the case on October 27, 1994.
