HC verdict on Nizam Hazari’s JS membership deferred again

The High Court (HC) yesterday again deferred till November 28 the pronouncement of its verdict on a writ petition filed challenging the legality of parliament membership of Nizam Uddin Hazari of Feni-2 constituency, UNB reports. A two-member HC bench comprising Justice Md Emdadul Haque and Justice FRM Nazmul Ahasan fixed the fresh date asking the lawyers to explain two issues about Hazari’s early release from jail.  According to a circular of 1959, an accused can enjoy 30 percent rebate on his total jail term while the ‘Jail Code’ allows 25 percent exemption, said Barrister Shafique Ahmed, counsel of Nizam Hazari.
The court asked the lawyers to explain which provision will be effective or whether both the provisions will come into effect simultaneously. The court also wanted to know about the legal basis of the circular of 1959. On August 17, the same bench set August 23 for pronouncing its verdict on the writ petition. Earlier, the HC bench sought the details of jail term served by the ruling party MP in an arms case. As the prosecution did not provide any document in this regard, the court deferred the hearing.  In 2014, the writ petition was filed with the HC attaching a newspaper report of May 10, 2014 stating that Nizam Uddin Hazari was awarded 10 years’ imprisonment in an arms case, but he was freed from jail two years and 10 months before the jail term completed.
