Why eviction of Santals not illegal

HC asks govt to explain

The High Court yesterday asked the government to explain why the eviction of Santal people in Shahebganj and Gobindaganj in Gaibandhawould should not be declared illegal. It also asked the government to explain why legal actions should not be taken against perpetrators of robbery at the houses of Santals on the farm land before setting them on fire and killing of two Santals by shooting after framing them as illegal occupants. In response to a writ petition, the HC bench comprising Justice Obaidul Hassan and Justice Krishna Debnath issued the rule. Two Santal women on November 21 filed a writ petition with the HC seeking its directive on the government to form a judicial enquiry commission to probe the November 6 incident in Gobindaganj of Gaibandha. The Santal victims -- Olivia Hembrom, wife of Dijen Tudu, and Rumila Kisku, wife of Ganesh Murmu, -- submitted the petition through their lawyer. Secretaries to the ministries of home, law, industries and land, inspector general of police, deputy commissioner and superintendent of police of Gaibandha, upazila nirbahi officer of Gobindaganj, officer-in-charge of Gobindaganj police station, managing director of Rangpur Sugar Mill, lawmaker of Gaibandha-4, and chairman of Sapmara Union Parishad have been asked to reply to the rule within two weeks.
Earlier, both the Santal women sent a legal notice seeking an explanation from the administration under what authority they had carried out the eviction.
The HC bench also fixed November 30 for final hearing on the petition, along with another petition on similar matter filed by Ain o Salish Kendra (ASK). In response to the ASK petition, the same bench of the HC had, on November 17, directed the government to either allow Santals to harvest rice they had grown on the farm lands or ask the mill authorities to harvest and give the crop to the Santals.
The Court had also asked the superintendent of police of Gaibandha and the officer-in-charge of Gobindagan police station to report to it in 10 days on what legal actions had been taken against the perpetrators of atrocities on the Santals.
