A writ petition was filed with the High Court yesterday seeking its directive upon Relief and Disaster Management Minister Mofazzal Hossain Chowdhury Maya to explain under what authority he is holding his member of parliament status and the post of a minister.
Advocate Eunus Ali Akond, a Supreme Court lawyer, filed the petition with the related branch of the HC seeking its directive in this regard.
Talking to The Independent, Akond said he would place the writ petition at the bench of Justice Naima Haider and Justice Mostafa Jaman Islam today for hearing. However, he said the hearing might take place after vacation as the Supreme Court would go on a 15-day vacation from July 12.
In his petition Akond mentioned that Maya cannot hold the offices of minister and parliament member as per Article 66 (2)(D) of the constitution as he is convicted in a corruption case as per a Supreme Court order.
Earlier, on June 14, Akond sent legal notice on Maya asking him under what authority the ruling Awami League (AL) leader and lawmaker is holding the offices despite the apex court annulled his acquittal in a graft case.
On June 14, the Appellate Division cancelled a High Court verdict that acquitted minister and senior Awami League leader Maya in a graft case of 2007.
It also asked the High Court to rehear the appeal filed by the minister with the High Court challenging a lower court judgment which had jailed him for 13 years in 2007.
