The High Court yesterday issued a rule asking the authorities concerned to explain within four weeks why the Election Commission (EC)’s decision of allocating “moshal” (torch) symbol to the faction of Jatiya Samajtantrik Dal (JSD) led by Hasanul Haq Inu should not be declared illegal.
In response to a writ petition filed by another JSD faction led by Sharif Nurul Ambia and Nazmul Haque Prodhan, the HC bench of Justice M Enayetur Rahim and Justice Ashish Ranjan Das issued the rule.
The JSD was split in its last national council on March 12 when a faction stood against Inu's bid to make Shirin Akhter the general secretary of the party. Later, both the factions moved the EC seeking ‘torch’ as party symbol.
Earlier, on April 28, the EC allocated the electoral symbol “moshal” to the faction of JSD led by Inu.
Following the EC decision, the other JSD faction submitted an application to the EC to review its decision. The EC on August 10 upheld its earlier decision disposing of the review application.
Sharif and Nazmul later filed the writ petition with the HC challenging the legality of the EC decision to allocate the torch symbol to the JSD faction led by Inu.
Advocate Shahdin Malik, counsel for the petitioners Sharif and Nazmul, told the court that the EC did not follow the party's constitution during the allocation of the torch symbol to Inu.
