The High Court yesterday sought an explanation from the government over the ambiguity in Children Act, 2013. The HC bench comprising Justice M Enayetur Rahim and Justice JBM Hassan asked the secretaries of legislative and drafting wing of law ministry and social welfare ministry to submit the explanation before the court within 7 days. Earlier, the HC bench told Deputy Attorney General Sheikh AKM Moniruzzaman Kabir that before deliberation of the judgement it is necessary for the court to know the government’s explanation over the ambiguity that remained in the Children Act, 2013. The government enacted the new Children Act-2013 for the benefit of its estimated 70 million children, repealing the Children Act of 1974. Under this new act, a children court has been set up in every district. Recently, the children courts of Dhaka, Chittagong, Cox Bazar and Rangpur heard bail petitions in four cases relating to rape of children. But, the HC issued a rule asking the judges of the said four children courts to explain why they have heard the bail petitions of those cases although the accused persons were adult persons.
