Judge suspended for misconduct

The government has suspended Additional District and Sessions Judge of Dhaka-5 Md Juel Rana for misconduct that includes bringing false allegations against Chief Justice Surendra Kumar Sinha. A circular issued by the law ministry said that Judge Juel Rana had displayed audacious, out of beyond etiquette, indecent, unrestraint behavior and brought false allegations against Chief Justice Surendra Kumar Sinha. Judge Juel Rana was earlier accused of irregularities and a probe, as per an apex court directive, by Dhaka District and Sessions Judge SM Kuddus Zaman found Judge Juel Rana responsible for massive irregularities in disposing of a number of cases. The circular also said that the allegations raised by the Supreme Court against Judge Juel Rana were serious.
The circular also said that the process is underway for filing of a departmental case against Judge Juel Rana for misconduct by undermining a four-member General Administration (GA) committee, led by Chief Justice Surendra Kumar Sinha. The law ministry has taken the decision in accordance with the recommendation of the GA committee of the Supreme Court, it said. Earlier, on June 28, the four-member GA committee comprising Chief Justice Surendra Kumar Sinha, Justice Syed Muhammad Dastagir Husain, Justice Zinat Ara and Justice Obaidul Hassan, at a special General Administration committee meeting recommended to the law ministry that the judge be suspended within three days.
It also recommended the law ministry to file a departmental case against him for alleged his involvement in corruption while he was discharging his duties as an additional judge of Dhaka-5.  The committee also asked the law ministry to appoint Narshingdi district and session Judge Begum Fatema Najib as the investigation officer of the case.  In its letter, the GA committee said that the Judge Juel Rana sent a letter to the President of Bangladesh through official channels stating that the chief justice recommended the law ministry to take departmental action against him(Judge Juel Rana) after collecting investigation reports, which were prepared against him by his (Chief Justice) favorite officials.
Judge Juel Rana also alleged that the chief justice took the decision against him without giving me any opportunity for self defense over the allegations brought against him, according to the GA committee letter.  After receiving a number of allegations against Judge Juel Rana, the Supreme Court conducted the investigation against him as per the rules. After getting the investigation report that found the allegations to be true, the apex court GA committee recommended the government to file a department case against him, the GA committee letter said. The GA committee also said there was no provision for giving any opportunity to an accused official for making self defense.
Considering the misconduct by Judge Juel Rana with the chief justice and GA committee members, the apex court recommended the law ministry to suspend him, after receiving a copy of the letter. Earlier on May 24, the Supreme Court consented to a government decision to file a departmental case against Judge Juel Rana for his alleged involvement in corruption. The four-member GA committee, led by the Chief Justice, had also asked the government to transfer Md Juel Rana to the law ministry after withdrawing him from his present workplace. The apex court also asked the government to appoint Women’s and Children’s Repression Prevention Tribunal of Dhaka judge, Saleh Uddin Ahmed, as the investigation officer in the departmental case. Earlier, when the allegations of corruption were levelled against him, the Supreme Court administration conducted an investigation headed by Dhaka District and Sessions Judge SM Kuddus Zaman. Zaman later submitted a report stating that Juel Rana was responsible for massive irregularities in disposing of case (dewlia) No. 16 of 2000 while he was serving as an additional judge of Dhaka-5.  Many other allegations of corruption against him were also proved during the investigations and the report recommended filing a departmental case against him. The law ministry then sought the Supreme Court’s approval to file a departmental case against Juel Rana on charges of corruption.
