The Chamber Judge of the Supreme Court (SC) yesterday sent to the full bench of the apex court an appeal petition, filed by Dhaka-8 lawmaker Rashed Khan Menon and Viqarunnisa Noon School and College, seeking a stay on a High Court (HC) order that has recently declared illegal the rules that allowed lawmakers to chair governing bodies at non-government schools and colleges.
Chamber Judge Justice Mirza Hussain Haider issued the order without giving any stay order on the petition and fixed June 12 for hearing on the appeal at the full SC bench of the apex court led by Chief Justice Surendra Kumar Sinha.
In an order on June 1, the HC declared illegal Sections 5 and 50 of Secondary and Higher Secondary Education Board Rules-2009 that allowed lawmakers to hold the post of chairperson in governing bodies of non-government schools and colleges.
In its order, the HC also cancelled the special governing body of Viqarunnisa Noon School and College headed by Menon, also the civil aviation and tourism minister.
The HC, however, said that existing governing body members of non-government schools and colleges would hold their posts until expiration of their tenures.
