Poll tribunals to hear aggrieved candidates

With the formation of election tribunals, now aggrieved candidates can file cases with them in their respective areas if they are not satisfied with the results of the recently-concluded Union Parishad polls.
The election tribunals were formed, comprising a Senior Assistant Judge, to dispose of complaints filed by aggrieved persons against poll anomalies, including vote rigging and election result manipulation, EC sources said. “Aggrieved candidates can go to the tribunal within 30 days of the publication of gazette notifications if they are not satisfied with the results of the UP polls. The tribunal will settle the matter within 60 days,” Md Mohsinul Haque, Deputy Secretary (Law) told The Independent yesterday.
The election tribunals were formed last Sunday after the EC sent letters to the respective authorities in this regard. The decision of the election tribunals can be challenged through the respective election appellate tribunals within 30 days of judgment being passed. The appellate tribunals will dispose of the complaints and appeal within 120 days. However, the appellate tribunals are yet to be formed though, according to EC sources, who said those would be formed soon.
The EC has started publishing gazette notifications of the just-concluded UP polls on March 22-31 since April 7. At least four people were killed in the last two phases of polls in violence related to vote rigging and other poll irregularities.
Candidates have been approaching the EC for justice, but the EC has said that aggrieved candidates can file cases with the election tribunals after the gazette notifications for respective UPs.
As per the UP election rules, aggrieved candidates will be able to file cases about election anomalies in the respective election tribunals, but they cannot file cases with other courts in this regard. Besides, none other than the candidates are allowed to file such cases.
The EC has made arrangements for holding polls in about 4,500 UPs in six phases and the polls will conclude on June 4.
