Kader Siddique files leave-to-appeal against HC order

Krishak Sramik Janata League president Kader Siddique yesterday filed a leave-to-appeal petition with Supreme Court against a High Court order rejecting his pleas for participating in the Tangail-4 by-election, reports UNB.
On February 4, the High Court rejected a writ petition filed by Kader Siddique challenging the legality of the Election Commission’s decision cancelling his candidature in the Tangail-4 by-election. On September 16, 2015 the EC issued a notification for fixing November 10 for the by-polls to the constituency that fell vacant following the resignation of Awami League lawmaker Abdul Latif Siddique from Parliament, and asked aspirants to submit their nomination papers within October 11.
The returning officer cancelled Kader Siddique's nomination in allegation of loan default charges on October 13. Kader Siddique appealed with the EC against the decision, but the commission rejected his plea on October 18.  Later he filed the writ petition with the HC against EC's decision.
Following his petition, the HC directed EC to accept his candidacy and also asked it and the government to explain why cancellation of his candidature should not be declared illegal On October 21.
Following a government petition against the HC order, the Appellate Division on October 27 stayed the election until November 2.
The apex court on the same day extended its stay order until the HC disposes of the rule and also asked the HC to dispose of it by January 31 this year.
