Attorney general Mahbubey Alam yesterday appealed to the Supreme Court to uphold the death penalty of war crimes convict and Jamaat-e-Islami chief, Motiur Rahman Nizami.
In his final argument on the case, the chief state counsel told the apex court that the International Crimes Tribunal (ICT) had rightly awarded the death penalty to Motiur Rahman Nizami, and the top court should uphold the sentence as the people were seeking justice for the 1971 martyrs.
Alam put forward these arguments before the four-member bench of the Appellate Division, headed by Chief Justice Surendra Kumar Sinha, during the final hearing on the appeal filed by Motiur Rahman Nizami against the tribunal verdict. The tribunal had handed down the death penalty on four charges of crimes against humanity committed during the 1971 Liberation War.
After concluding yesterday’s hearing, the apex court asked the defence counsel to submit his arguments today (Tuesday).
Alam also said that Nizami had instigated the Al-Badr Bahini, an auxiliary force of the Pakistani army, for killing people, including intellectuals, during the 1971 war.
Responding to the points of defence arguments, the chief law officer of the state said that the defence lawyer’s arguments on the charges brought against Nizami were not acceptable as the ICT-1 had properly delivered the verdict.
Earlier, Alam told reporters that the defence counsel of death-row convict Motiur Rahman Nizami had apparently pleaded guilty on behalf of his client and appealed to the Supreme Court to commute the death sentence.
