SC upholds HC order on Fakhrul bail
The Appellate Division of the Supreme Court yesterday upheld a High Court (HC) order that had granted bail to BNP Acting Secretary General Mirza Fakhrul Islam Alamgir in three arson and vandalism cases paving way for him to walk out of jail. After concluding hearing on an appeal filed by the government for staying the operation of the HC bail order, a four-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha passed no order. There is no legal bar to release Fakhrul from jail following the apex court order, Advocate Sabir Hossain Leon, one of the counsels for Fakhrul, told reporters. On November 22, the HC bench of Justice Md Rezaul Haque and Justice Md Khasruzzaman granted bail to Fakhrul for three months in the three arson and vandalism cases on medical grounds. The HC bench came up with the orders after final hearing on three separate rules issued by it earlier asking the government to explain, in four weeks, why the BNP leader should not be granted regular bail in the three cases. The law enforcers, on January 4 and 6, filed three cases against Fakhrul with Paltan Police Station for ordering, abetting and instigating unidentified party men to blast several crude bombs, vandalise five buses and a police bike and set them on fire in the capital on January 5.
