SC to hear defence from Nov 30

The Appellate Division of Supreme Court will start hearing arguments by defence counsel on November 30 the appeal filed by Jamaat-e-Islami Ameer Matiur Rahman Nizami challenging his death penalty for wartime offences. A four-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha fixed the date to begin hearing arguments on the case after a six-day hearing on the appeal.

After concluding yesterday’s hearing on the appeal, the apex court said it would hear arguments by Nizami’s counsel from November 30 to December 2 and those by the Attorney General on December 7. The defence counsel will allow replying on state arguments on November 8 after which, the apex court may fix a date for passing verdict on Nizami’s appeal; said the lawyers in question.
Defence lawyer S.M. Shahjahan moved for appeal petition while Attorney General Mahbubey Alam will stand for the state. Earlier, on September 9, the apex court had started hearing on Nizami’s appeal challenging the International Crimes Tribunal verdict awarding him death penalty for wartime offences. It resumed hearing on November 17.
On October 29 last year, the ICT-1 found 71-year-old Nizami guilty in eight of the 16 war crimes’ charges leveled against him, and handed him death penalty on four charges and lifetime imprisonment on the other four. Nizami was acquitted of eight other charges as prosecution failed to prove them. Thereafter, on November 23 last year, Nizami filed an appeal before the Supreme Court, challenging the ICT-1 verdict.
The appeal, containing 6,252 pages, cited 168 reasons for him to be discharged from war crimes’ charges. On January 30 this year, a Chittagong court also sentenced him to death in the 10-truck arms’ haul case. His appeal in the case is yet to be disposed of by the High Court. Nizami is presently lodged in the Kashimpur high security prison in Gazipur.
