The High Court yesterday rejected a writ petition filed challenging the legality of Mofazzal Hossain Chowdhury Maya continuing as minister and lawmaker after the Supreme Court scrapped his acquittal in a corruption case.
After concluding the hearing, third bench of the HC of Justice Syed Refaat Ahmed passed the final order.
The HC rejected the petition on consideration that an appeal of Maya challenging the lower court verdict that jailed him for 13 years is pending before the HC, deputy attorney general Motaher Hossain Sazu said.
Sazu also said the HC also considered that the parliament and Election Commission can take decision over his parliamentary membership. Hence, the HC rejected the petition, he added.
Justice MA Wahhab Miah, the senior judge of the Appellate Division, who is functioning as Chief Justice in absence of Surendra Kumar Sinha, had assigned the case to the HC bench of Justice Syed Refaat Ahmed. He sent it to the HC bench, along with a split order, for final disposal of the petition.
