A fresh debate has arisen over the execution timeframe of the two top war criminals—Ali Ahsan Muhammad Mujahid and Salahuddin Quader Chowdhury—as the apex court did not issue a short order of its verdict.
Attorney general Mahbubey Alam said there is no need for the full copy of the review petitions' verdicts to carry out the executions, as the legal procedures ended through the dismissal order of the apex court. "So, now their execution is just a matter of time," he added.
On the other hand, the chief defence counsel, advocate Khandaker Mahbub Hossain, said they have lost the legal battle. Now, his clients can only seek justice from the almighty Allah, he added.
He said the apex court will now send the full copy of the review petitions' verdicts to the tribunal after which the tribunal will communicate the order to the jail authorities. After that, the authorities concerned will ask Mujahid and Chowdhury whether they would seek presidential clemency. If not, the government can implement the apex court order, he added.
Mahbubey Alam said there is now no legal bar to execute the war criminals, following the rejection order of their review petitions. “Legal procedures ended today with the dismissal of the review petitions. Now, there is no legal barrier to execute them,” he added.
When asked if any short order is required, the attorney general said, “I had sought the order in court, but they said a short order is unnecessary, as the case has already been dismissed and there is no suspension order.”
When asked whether there is any time-frame for the execution, he said, “The law does not specify anything regarding this.”
Regarding presidential clemency, Mahbubey Alam said there is no time bar for Chowdhury and Mujahid to seek mercy. “They may be asked whether they would seek clemency. If they do, their prayers will be sent to the President,” he added.
The government had earlier executed war criminal Muhammad Kamaruzzaman after the apex court dismissed his review petition.
On April 6, a four-member bench of the apex court, led by Chief Justice SK Sinha, had dismissed the review petition of Kamaruzzaman, paving the way for his execution.The apex court, on April 8, released its full verdict that dismissed the review petition of Kamaruzzaman after all the four judges signed it.
On April 11, the government executed Muhammad Kamaruzzaman, after completing all legal procedures.
