PEC expulsion rule cancelled

The government has informed the High Court (HC) that it has already cancelled the provision of expelling examinees from the Primary Education Completion (PEC) and its equivalent Ebtedayee examinations. After appearing before a HC bench as per its earlier directive, Sohail Ahmed, Additional Director General of the Directorate of Primary Education, informed the court yesterday that the government cancelled the rule 11 of the concerned law clearing the way for no expulsion for the PEC and its equivalent examinees.

Therefore, he added, there is no scope for expulsion of the children during PEC examinations from now on. Earlier, a HC bench in this regard exempted the DG from personal appearance and directed the authorities concerned to give moral education to the children. The HC bench, comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman, also disposed of its rule, issued on November 21 last year, asking the authorities concerned to explain why the expulsion of children during PEC examinations should not be declared illegal.

In a suo moto move, the HC bench also asked why section 11 of the directives of the Directorate of Primary Education, issued in 2018, should not be declared illegal. This particular section had directions on taking actions for ‘breaching disciplines’. The children were expelled for allegedly adopting unfair means. On December 18 last year, the HC gave directives to the government to retake exams of the expelled PEC students by December 28 and publish their results by December 31. It also summoned the director general (DG) of the Directorate of Primary Education.

Earlier on November 21, the HC issued a rule asking why the expulsion of the PEC students should not be declared illegal. Some 15 students had been expelled during the PEC and Ebtedayee examinations across the country this year. The Primary and Mass Education Secretary and the DG of the Directorate of Primary Education, among 10, had been made respondents to the rule asking to reply by December 10. Advocate Jamiul Haque Faisal represented the writ petitioner while Deputy Attorney General Amit Talukdar stood for the state with Advocate Shafik Mahmud representing the DG.
