The acting Chief Justice yesterday assigned a High Court (HC) bench for the final hearing of a writ petition, challenging the legality of Mofazzal Hossain Chowdhury Maya's continuing as minister and lawmaker. The Supreme Court had scrapped his acquittal in a corruption case.
Justice MA Wahhab Miah, the senior judge of the Appellate Division, who is functioning as Chief Justice in absence of Surendra Kumar Sinha, assigned the case to the HC bench of Justice Syed Refaat Ahmed. He sent it to the HC bench, along with a split order, for final disposal of the petition. Deputy attorney general Motaher Hossain Sazu confirmed the matter to reporters, saying that the HC bench will now fix a date for hearing on the petition.
Earlier, on August 17, a division bench of the HC had delivered a split order on the legality of Awami League (AL) leader Maya’s membership of parliament and ministership with regard to his conviction in a graft case. At present, Maya is convicted in a corruption case, which carries a 13-year jail term and Tk 5cr fine for amassing illegal wealth.
Justice Moyeenul Islam Chowdhury, senior judge of the HC bench, issued a rule, asking Maya to explain under what authority he is currently holding the offices of minister and an MP in 2 weeks. Justice Md Ashraful Kamal, junior judge of the same bench, however, rejected the writ, saying that Jatiya Sangsad Speaker and the Election Commission (EC) should handle any dispute in this regard.
The HC bench sent the split order to the Chief Justice to constitute a third bench for final disposal of the petition. The bench came up with the order after concluding hearing on a writ petition filed by a Supreme Court lawyer, advocate Eunus Ali Akond, challenging the legality of Maya's membership of Parliament.
