Fresh judicial probe finds no change in charge sheet

The chief judicial magistrate of Narsingdi has recently submitted a charge sheet in the Narsingdi Mayor Lokman murder case, dropping names of 11 FIR accused, as was done in the earlier charge-sheet by the DB police, which had been rejected by the plaintiff. Chief Judicial Magistrate Md Raquibul Islam, who is also the investigation officer of Lokman Hossain murder case, submitted the fresh charge sheet before the Narsingdi District Session Judge court last week against 12 persons, who were also accused in the previous charge sheet placed by the DB.

The judicial magistrate has dropped the names of 11 persons, including an ex-minister’s brother, ex-Narsingdi city unit AL president and ex-minister’s APS, all FIR accused in the murder case, which has disappointed the family members of slain mayor Lokman. The re-investigation was carried out after the Appellate Division directed a judicial magistrate to conduct further probe into the murder of Narsingdi Mayor Lokman Hossain, as the victim’s family rejected the DB police charge sheet.

Charge sheet accused persons are : Mobaraka Hossain Moba, ex Narsingdi Poura Chairman Abdul Matin Sarker, his brother Ashraf Hossain Sarker, Nazmul Hasan Sharif alias killer Sharif, His brother Hira, Sabuj Mia, Shahin Mia, Awlad Hossain, Hazi Faruque, Hazi Selim and Yusuf Sarker.

After the DB police earlier submitted the charge sheet against

these same people, family members of the slain mayor filed a ‘Naraji’ petition before the lower court. The lower court, however, rejected the petition and accepted the charge sheet.

The family then moved to the High Court, which allowed the petition and ordered judicial probe. The order was upheld by the Supreme Court which ordered a judicial magistrate to conduct re-investigation into the case. However, the re-investigation by a judicial magistrate has not found any involvement of the trio in the killing and the probe has accused the same persons as was done by the DB police.

Before submitting the charge sheet, Chief Judicial Magistrate Md Raquibul Islam talked with plaintiff Kamruzzaman Kamrul, Lokman’s wife Bubly, and recorded eyewitness statements in connection with the killing case.  

After a 7-month long investigation, the chief judicial magistrate dropped 11 names from the First Information Report (FIR) including the name of Salahuddin Ahmed Bachchu, a younger brother of former telecommunication minister, ex-minister’s APS Murad Ahmed and former Narsingdi city unit AL president Montaj Uddin Bhuiyan.

Lokman Hossain was shot in front of the district Awami League (AL) office in Sadar Road on November 1, 2011 and succumbed to his injuries at Dhaka Medical College and Hospital a day after he was admitted.

On November 3, Lokman’s younger brother Kamruzzaman Kamrul filed a murder  case with Narsingdi sadar thana against 14 persons including Salahuddin Ahmed Bachchu, Murad Ahmed, Abdul Matin Sarker, Montaj Uddin Bhuiyan, ex city Juba League president Ashraf Hossain sarker, ex city unit Awami League treasurer Mobarak Hossain Moba, Juba League leader Kabir Sarker, ex BCL leader Mia Monjur, Juba League leader Amir Hossain, his brother Hiron Mia, Mamun,  printing press owner Moyeen ,BNP leader Tarek Ahmed and BNP leader Nurul Islam.

Police later arrested nine unidentified accused and 9 persons gave confessional statement to judicial magistrate under section 164.

After conducting investigation, DB Inspector Mamun Or Rashid Modal submitted charge sheet to the Chief Judicial Magistrate court against 12 persons including three FIR accused and removed the remaining 11 FIR accused from charge sheet on June 27, 2012. Lokman’s brother Kamruzzaman Kamrul and his family members, however, rejected the charge sheet.

On August 5 Chief judicial Magistrate Nitai Chandra Saha rejected the Naraji petition and accepted the charge sheet and released 11 persons from the murder case.  

Later, following a petition filed by Lokman’s family, the HC in 2018 asked the chief judicial magistrate of Narsingdi to conduct a fresh investigation.

Following a government appeal, the Supreme Court upheld the HC order in March this year. After conducting investigation, Chief judicial Magistrate of Narsingdi submitted the fresh charge sheet to Narsingdi District and Session Judge’s court recently, dropping the names of 11 FIR accused persons from the charge sheet.
