SC asks GP how much it can pay BTRC

The Appellate Division of the Supreme Court (SC) yesterday wanted to know from the country’s biggest mobile phone operator, Grameenphone (GP), the amount it could pay the Bangladesh Telecommunication Regulatory Commission (BTRC) out of its Tk. 12,579 crore dues.

The apex court asked the lawyers of GP to provide the information during the next hearing on October 31. Barrister Fazle Noor Tapas and advocate AM Amin Uddin appeared for GP during yesterday’s proceedings. A seven-member full bench of the Appellate Division, headed by Chief Justice Syed Mahmud Hossain, came up with the order while hearing a petition filed by the BTRC seeking a stay on a High Court (HC) order that had issued an injunction for two months on the BTRC demand to realise Tk. 12,579 crore from GP.

The apex court also fixed October 31 for further hearing on the BTRC petition. Attorney general Mahbubey Alam represented the state, while barrister Khandaker Reza-e-Rakib stood for the BTRC.

Earlier, on October 17, the HC had issued an interim injunction order for two months on the letter issued by the BTRC, asking GP to pay Tk. 12,579 crore in dues. The HC bench of Justice AKM Abdul Hakim and Justice Fatima Nazib had issued the injunction against the BTRC move.

Later, the BTRC moved SC against the HC order. During the hearing on the BTRC petition, the apex court gave the order yesterday.

Meanwhile, another HC bench yesterday deferred until November 3 the passing of its order on an appeal filed by Robi Axiata Ltd seeking an injunction on the BTRC demand of Tk. 867.24 crore from Robi in dues.

After concluding the hearing on the appeal on October 22, the HC bench, comprising Justice Mamnoon Rahman and Justice Khizir Hayat, had fixed October 24 for delivering its order on the matter. But the same bench yesterday deferred till November 3 the passing of its order on the matter.

On July 31 last year, the BTRC had year issued a notice asking Robi Axiata to pay Tk. 867.24cr as dues. But the mobile telecom operator filed a petition at the lower court, seeking an injunction on the realisation of money by the BTRC. However, the lower court turned down Robi’s petition.

On October 20, Robi Axiata moved the HC with an appeal against the lower court order and sought an injunction on the BTRC’s move to realise the money from the mobile operator.
