The chamber court of the Appellate Division yesterday upheld a High Court order that granted bail to Tanzila Haque Chowdhury Mitu in a case filed for allegedly provoking her husband Mustafa Murshed Akash to commit suicide.
Chamber Judge of the Appellate Division Justice Hasan Foez Siddique passed ‘no order’ on a petition filed by the government seeking a stay on the HC order.
The ‘no order’ means the HC order granting bail to Mitu in the case will remain in force, said the lawyers concerned.
Earlier on August 28, the HC bench comprising Justice Md Emdadul Huq and Justice Kazi Md Ejarul Haque Akondo granted permanent bail to Mitu in the case.
Akash, 32, a doctor of Chattogram Medical College Hospital, died reportedly by committing suicide at his residence in Chandgaon Residential Area in the port city on January 31. Before suicide, the physician posted a “suicide note” on his Facebook timeline.
Family members said Akash, prior to his apparent suicide, had shared photos of wife Mitu on his Facebook profile and wrote about her alleged extramarital affairs before announcing his decision to end his own life.
Following the incident, the Counter-Terrorism unit of the Chittagong Metropolitan Police arrested Mitu from her relative's house in Nandankanan area at night on January 31.
Akash's mother Jobeda Khanam filed a case on the following day accusing Mitu and five others for instigating the suicide.
