New cabinet likely by Jan 5

 The Awami League (AL)-led Grand Alliance, which has won 259 seats in the 300-seat Jatiya Sangsad, is likely to form the new Cabinet with January 5, according to sources in the Cabinet Division. But first, the Election Commission (EC) will issue a gazette notification of the newly elected MPs within a day. Then, the present speaker, Dr Shirin Sharmin Chaudhury, will administer the oath of office to them within two or three days.

Legal expert Barrister Shafique Ahmed, who is also a former minister, said the newly elected MPs will be deemed to have entered office immediately after taking the oath. “I hope that the formation of the new Cabinet would be completed within a week of the New Year 2019,” he added.

Cabinet Division joint secretary (Rules and Service Branch) Shafiul Azim told The Independent: “We have completed all the process of forming the new government and help the President to administer the oath of office to the new Cabinet”.

Article 56 (1) of the Constitution says that there shall be a Prime Minister, other ministers, state ministers and deputy ministers as may be determined by the Prime Minister.

“The appointments of the PM, other ministers, ministers of state and deputy ministers shall be made by the President, provided that not less than nine-tenth of their number shall be appointed from among the members of Parliament and not more than one-tenth of their number may be chosen from among persons qualified for election as members of Parliament,” it states.

 “The President shall appoint as Prime Minister the member of Parliament who appears to him to command the support of the majority of the members of parliament” it further states. For the fourth time, AL president Sheikh Hasina is set to become the PM after her party-led alliance’s landslide victory in the 11th parliamentary polls on Sunday.
