According to media reports one of the most dreaded criminals of Dhaka, nay the country, Sheikh Aslam alias Sweden Aslam, now serving time at the Kashimpur High Security Prison on murder charges is likely to come out of jail any time.. Moves have been made, on his behalf for bail and many believe that if he does get the bail it will not augur well for the law and order situation of the city. He still poses a threat to society as he allegedly continues to have links with criminal elements operating here.
Granting bail in cases of non bailable offence is the root cause behind the fact that the criminal justice system is not as effective as it should be. It has been observed that vicious criminals habitually engage in criminal activities and also intimidate the plaintiffs who are seeking remedy. Of course granting bail is in the discretion of the court but in most of the cases it is seen that the law officers of the government side did not do enough to prevent offenders from getting bails. There just isn’t enough incentive for the public prosecutors to ensure that accused people who are a threat to the society do not get bails easily. The police are often seen unable or unwilling to investigate properly and put forth enough evidence to ensure that hardened criminals do not get bail. This undoubtedly is a frustrating situation. Not only criminals the rich and powerful get bail much more easily with better lawyers and judges in favour of the wealthy and powerful. On the other hand the poor suffer further imprisonment.
No steps should be taken that elevate the so-called liberties and rights of hardened criminals at the expense of the safety of the larger community. Criminals on bail are elevated to Mafia-style bosses because, when they re-join the society, they coordinate criminal activities from behind the scenes. While the rule of natural justice advocates presumption of innocence until guilt is proven the overwhelming majority of Bangladeshis believe that the courts should deny accused individuals bail on account of the seriousness of their criminal records. If high profile criminals get bail too easily conviction rates would continue to plummet as potential witnesses avoid testifying against persons who can pose a threat to their lives and property.
We believe the refusal to grant bail does not reflect on whether the accused will later be found guilty or not, nor does it make it easier for the prosecution to prove the accused is guilty. A court, in refusing to grant bail when the conditions for granting it are absent, in no way breaches the fundamental rights of the accused.
