The Appellate Division of the Supreme Court yesterday stayed the High Court (HC) order directing two bus owners to give Tk 1 crore to the family of Rajib Hossain, who was killed after losing an arm to a road accident in the capital recently. However, the apex court directed the High Court Division to form an independent committee to assess the liabilities of the two bus owners for the accident that caused death of Rajib Hossain, a student of Government Titumir College.
Rajib lost his right hand after it got stuck between two buses in the city on April 3, and subsequently succumbed to injuries at Dhaka Medical College and Hospital on April 17.
The Appellate Division in its order also asked the High Court Division to direct the
committee to submit the assessment report within 30 days.
After getting report from the committee, the High Court will determine the compensation for the family members of Rajib and it will direct the responsible parties — Sajan Paribahan and Bangladesh Road Transport Corporation (BTRC) — to pay adequate compensation to the two orphan brothers of the deceased, Supreme Court order said.
A four-member bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain passed the directives after disposing of separate appeals filed by the BRTC and Sajan Paribahan seeking stay on the compensation imposed on them.
Earlier on May 8, in an order, the High Court directed the BRTC chairman and Sajan Bus Company’s managing director to pay Tk 50 lakh each as compensation to Rajib’s brothers, who were dependent on him.
The court had also asked Sajan and the BRTC to submit a compliance report to the court during the next hearing set for June 25.
A bench of Justice Salma Masud Chowdhury and Justice AKM Zahirul Hoque issued the compensation order after hearing a writ petition filed by Supreme Court lawyer Ruhul Quddus Kazal.
But, the BRTC filed the petition on May 10 seeking a stay on the HC order that asked it to pay Tk 25 lakh within one month to Rajib's family. Sajan Paribahan recently filed a separate petition on similar ground. After hearing the appeal petitions, the apex court yesterday came up with the order.
Advocate Abdul Matin Khasru appeared for the BTRC while Ruhul Kuddus Kazal represented Rajib family.
