Pay Rs 5 lakh to Felani kin as compensation

The National Human Rights Commission of India (NHRC) yesterday recommended that the Indian government gives Rs. 5 lakh as compensation to Felani’s family.
A tearful Nur Islam, Felani’s father, said, “I do not want the money, I want justice for my daughter’s killing. The BSF man shot dead my daughter in front of me and I have been waiting for justice for the killing of Felani for more than four years now.”
Advocate SM Abraham Lincoln, Kurigram Public Prosecutor and lawyer in the Felani murder case representing Bangladesh, said, “The Indian NHRC convened a full bench at its own initiative and took the decision of directing the Indian central government to pay Rs. 5 lakh as compensation to Felani’s family through the Indian High Commission in Bangladesh.”

“Primarily, it proved that India has accepted Felani’s killing by a BSF personnel. On their own they have taken the decision of providing the compensation. As a result, the crime of the accused BSF soldier, Amiya Ghosh, has been accepted and it has become a trial-able offence. We now hope that the accused will be given the rightful punishment, while the compensation is only a token gesture,” said Abraham Lincoln.
Early morning on January 7, 2011, a 14-year-old Bangladeshi girl, Felani Khatun, was shot dead by BSF soldier, Amiya Ghosh, when she along with her father, Nurul Islam, were trying to enter Bangladesh after crossing the barbed-wire fence at the Aanatapur border point in Phulbari upazila of Kurigram district.
Islam managed to get inside Bangladesh by scaling the barbed-wire fence, but Felani was shot dead by the BSF personnel before she could cross over. In this connection, a trail started on August 13, 2013 in a BSF special court at the 181 BSF Battalion headquarters in Cooch Bihar district of West Bengal in India. Initially, the special court on September 6, 2013 declared Amiya Ghosh (member of 181 BSF Battalion) not guilty.
Islam then appealed to the Indian High Commissioner in Bangladesh for revision trial of the case. On his appeal, the revision trial began in a special court on September 22, 2014, which also acquitted Ghosh on July 2 this year.
Following that Islam requested the Indian Manabadhikar Sangstha (Masum) to take necessary steps to file a case in the Indian Supreme Court. In this connection, Masum filed a writ petition on July 14 this year. The court on August 26 scheduled the date for next hearing on October 6. Meanwhile, the Indian NHRC took the initiative to convene a full bench and decided to give Felani’s family a compensation of Rs 5 lakh for their loss.
