Proshika ex-chair Qazi Faruque jailed for a month

The High Court (HC) yesterday sentenced the ousted chairman of Proshika, Qazi Faruque Ahmed, to one month’s civil imprisonment for violating its 2009 directive. In its directive, the HC on August 10, 2009 had ruled that Qazi Faruque Ahmed would be treated as the former chairman and former president of Proshika. It had ruled that Proshika would be run as usual by its existing governing body, saying that Qazi Faruque Ahmed must be kept out of the office. The HC had also directed the parties concerned in Proshika to maintain the status quo concerning the chairman’s office. As Quazi Faruque Ahmed did not comply with its earlier directive, the single-member HC bench of Justice Md Mozibur Rahman Miah yesterday awarded him one month’s imprisonment in civil prison and directed him to hand over the belongings of the Proshika chairman’s office to the non-government organisation’s chairman advocate MA Wadud.

 The HC also directed the authorities to submit a report to it within 15 days of complying with its order.

On August 9, 2010, the Appellate Division of the Supreme Court (SC) upheld a HC ruling saying that Qazi Faruque Ahmed would be treated as the former chairman and former president of Proshika. A four-member bench of the Appellate Division, headed by Justice Shah Abu Nayeem Mominur Rahman, passed the order, after disposing of a leave-to-appeal petition filed by Qazi Faruque, challenging the HC decision.

On May 24, 2009, the then governing body of Proshika replaced Qazi Faruque with MA Wadud as its chairman in the face of employees’ agitation against Faruque for his alleged corruption and nepotism.

Faruque, along with his hired men, launched attacks on Proshika employees at several places in the capital on August 1, 2008, leaving at least 20 injured, in a bid to enter the NGO’s office at Mirpur-10.

After being removed, Faruque filed a case with the first assistant judge’s court on May 27, 2009, challenging the governing body’s decision. However, the court rejected the petition on May 31.

Faruque then filed an appeal with the district judge’s court on June 1, 2009, but that too was rejected on June 6. He, finally, filed a civil revision case with the HC.

On August 10, 2009, after holding a long hearing on the revision petition, the HC bench said in its verdict that Qazi Faruque Ahmed would be treated as the former chairman and former president of the organisation.
