The Appellate Division of the Supreme Court yesterday upheld a High Court order that rejected a writ challenging the Dhaka University (DU) authorities’ decision that barred admission seekers from sitting for entry tests for a second time. A four-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha passed the order after dismissing an appeal jointly filed by 26 guardians of admission seekers seeking the apex court directives on the DU authorities to allow the students to sit for entry tests for a second time.
Advocate AFM Mesbahuddin, counsel for the DU, told reporters that the HC had earlier upheld the DU decision barring admission seekers to sit for admission tests for second time. After the Appellate Division order, there is now no scope for the admission seekers to sit for entry tests for second time.
 The new system would come into effect in the upcoming 2015-16 academic session and those, who have passed this year’s HSC and equivalent examinations, would only be able to apply for the entry tests. It may be mentioned that the DU authorities initiated the online admission process for the 2015-16 academic session from yesterday.
Earlier, on August 26, the HC in an order upheld the decision by the Dhaka University authorities to bar admission seekers from sitting for the entry tests for a second time.
Rejecting a joint writ petition by 26 guardians against the university’s decision, a bench of Justice Farah Mahbub and Justice Md Ezarul Haque Akondo observed that around half of the admission seekers, who have already got admitted to the university the previous year, sit for the entry tests again to get their desired subjects.
Therefore, a good number of fresh admission seekers do not get a chance, the HC added.
The petitioners said the restriction on seeking admission for a second time violates articles 15, 17 and 19 of the constitution that ensured the fundamental principle of equal opportunity for education. They had then filed the joint writ petition.
