16th Amendment verdict

Govt to file review plea by 28 days

The government will file a review petition, seeking some changes in the observations made by the Appellate Division in the verdict repealing the 16th Amendment to the Constitution, within next 28 days. The 16th Amendment empowers Parliament to remove judges for "inability" and "misconduct".

The minister for law, justice and parliamentary Affairs, Anisul Huq, said this while talking to reporters after an agreement-signing programme at Hotel Sonargaon. He made the comments a couple of days after the state received the certified copy of the verdict. “ We have 28 days in hand and we shall file the petition by this period,” he added.

The minister further said if they fail, a condonation petition would be filed before the Appellate Division, explaining the reasons for the delay.

The attorney general, Mahbubey Alam, told reporters on Wednesday that they received the certified copy of the verdict two-three days ago.

The 799-page full verdict was published on August 1. The deputy attorney general, Ekramul Haque Tutul, told reporters that the state sought the certified copy on the very day of the announcement of the verdict. The Appellate Division unanimously announced the verdict on July 3, upholding the High Court verdict scrapping the 16th Amendment. The present Parliament brought the 16th Amendment on September 17, 2014.
