The High Court yesterday issued a rule asking the authorities concerned to explain why the function of the current Board of Directors of Bangladesh Cricket Board (BCB) should not be declared illegal.
However, the HC bench did not pass any stay order on the annual general meeting (AGM) and extraordinary general meeting (EGM) of the Bangladesh Cricket Board (BCB) that scheduled to be held on October 2.
A vacation bench of the HC comprising Justice SM Emdadul Hoque and Justice Bhishmadev Chakrabortty issued the rule and order after hearing on a writ petition filed challenging the legality of Bangladesh Cricket Board’s activity and proposed Annual General Meeting (AGM).
Seven people, including the secretary of the Ministry of Youth and Sports, chairman of the National Sports Council (NSC) and the president of BCB, have been made respondents to reply to the rule within four weeks.
Earlier, the present Board of Directors of the Cricket Board declared to hold the AGM after claiming that the Supreme Court recently gave the verdict in favour of them. Then, Mubasshar Hossain sent a legal notice asking the current cricket board authority to refrain from holding the AGM.
As the BCB did not reply to the legal notice, former BCB director Mubasshar Hussain filed the writ challenging the legality of convening the AGM and EGM.
Mubasshar claimed that according to the Supreme Court verdict, the BCB has no legal rights to call Annual General Meeting. However, BCB is planning to host the AGM on October 2 at a city hotel.
The present board of directors of BCB was formed on 10 October in 2013.
Former attorney general AJ Mohammad Ali and Barrister Mahbub Shafique and KM Hafizul Alam took part in the hearing on behalf of the petitioner while attorney general Mahbubey Alam represented the BCB during the hearing.
