Bangladesh Cricket Board (BCB) president Nazmul Hassan Papon said the ICC is concerned about the legal battle with the constitution that the board faced from its opposition party at the moment.
The BCB boss reiterated his stance on continuing the usual activities of the board since the court has no bar with it even though the oppositions repeatedly tried to stop it. “I don’t know why they engage in a legal battle. But I heard he (Mubassher Hossain Chowdhury) filed many cases related the sports. We have no problem if he keeps doing it. The only problem is that I have to face question regarding this in ICC. The ICC is very concerned in this matter,” Papon said.
“We got a letter from him (Saber Hossain) first after which we got a legal notice. What we understood is –AGM and EGM which we declared, we can’t do that and another one is our activities should be stopped.
“But we are going on with our usual activities. That time when they gave legal notice we said we’ll carry on our duty. Then they filed a writ and a hearing was held. This is legal matter so the legal experts can say the best. But what we knew so far that we have no bar to continue our activities. And we don’t have any bar also to conduct AGM and EGM as scheduled. Till now I don’t see any reason to be upset.”
“He (Saber Hossain) asked me to stop EGM and AGM in his letter but court said there is no bar. Now should I stop it only for his letter? I think only seven people in the country think that cricket hasn’t had any success. They even didn’t congratulate me on team’s success whereas whole Bangladesh congratulated our effort. They even didn’t see any success of us. What we consider as success, they think it as failure. How can we have a mutual understanding with them? I think if Bangladesh plays badly, they will be happy. Then they will not file any case. Their mentality doesn’t match with us.”
In the wake of the legal battle, however, the election might be delayed, Papon hinted.
“We didn’t reach any concrete decision as of now. The first priority is to conduct AGM and EGM. We need a legal constitution first by which the election will be held. How I can do election if it is not approved. NSC normally delays to give approval. These all are inter-related. After we get, the board will decide the next course of action. Then the date of the election will be given. An election commission will be formed. A list of councilors would have to be prepared. Constitution certainly gives timeframe for an election. So if we need much time than that, we need to consult our lawyers and legal advisers. So it’s tough to say at the moment “When the election will be held.”
The BCB chief once again said that the constitution of 2008 which the group of Saber Hossain Chowdhury wants is not prepared in line with the ICC rules. According to Papon, “As per the guideline of Appellate Division we prepare a constitution and the 2013 election was held.”
“High Court gave order that NSC has no right to amend the constitution. As per their guideline, we decided that the amended that was made, we’ll raise it to our councilors. If the councilors approve it, it will be approved otherwise it will be ruled out. So how can we say about that much earlier?” Papon said, giving an explanation in the wake of question of his opposition party.
