HC issues rule on admission fee

The High Court yesterday asked the government to explain within four weeks why its decision fixing Tk 19.9 lakh as the admission and tuition fees for candidates of MBBS and BDS courses in private medical colleges should not be declared illegal. In response to a writ petition, a vacation bench of the HC, comprising Justice M Enayetur Rahim and Justice Jahangir Hossain, came up with the rule.

Supreme Court lawyer advocate Eunus Ali Akond filed the petition, challenging the legality of the government’s decision. Health secretary, director general of the Directorate of Health Services, vice chancellor of Dhaka University and National Medical College and its governing body have been made respondents to the rule that has been replied to within four weeks.

The health secretary had on October 26, 2014 issued a notice fixing Tk 19.9 lakh as the admission and tuition fees for students seeking admission to MBBS and BDS courses in private medical colleges.

In the petition, Akond said the government had no authority to impose any condition regarding the admission of students to MBBS and BDS courses offered by institutions. Akond told reporters that the government decision was discriminatory for the private MBBS and BDS admission seekers.

During the hearing, Akond also told the court that the government decision was contradictory to Article 27 and some sections of the Constitution.

The HC bench issued the rule after the hearing.
