BTRC fails to inform lawyer about steps taken

A lawyer at Chittagong Judge’s Court, who had filed a complaint with Bangladesh Telecommunication Regulatory Commission (BTRC) against Grameenphone about being cheated on a package deal, is yet to get any response from the regulator.

Seven months back, BTRC had decided to inform SHM Habibur Rahman Azad about the measures it took taken against the country’s largest telecom operator.
The BTRC decided at its 199th meeting that it would inform him about the seven decisions taken by a committee that was formed to investigate his complaints. But ultimately, the BTRC did not inform him.
Azad had filed a complaint in Metropolitan Sessions Judge Court against Grameenphone, alleging that it had cheated him with a special ‘40 GP-GP minutes’ offer. He had bought the offer on September 20, 2012. The operator had sent him a confirmation message after deducting Tk. 11.50 from his account.
Later, he got an SMS from the operator saying it could not activate the service. But he did not get back the money. He took up the matter with Grameenphone but got neither a convincing reply nor his money.
The court ordered a judicial investigation. Metropolitan magistrate Nur-e-Alam Bhuiyan submitted the inquiry report on April 30, 2013. On June 20, 2013, metropolitan magistrate Lutfur Majid advised Azad to file a case under the Telecommunications Act 2001.
Azad, armed with a power of attorney from BTRC, went to EPZ police station in Chittagong to file a case on January 28, 2014. “After keeping me waiting for a long time, they refused to lodge a case and advised me to file a complaint in court,” Azad recalled.
“After several hearings, the court asked me to file a complaint with BTRC,” he said. On November 3, 2014, he filed a written complaint with the commission.
After not getting any result, on March 29, 2017, Azad filed a case in Chittagong Metropolitan Magistrate Harunur Rashid’s court.
The 22 accused included former Grameenphone CEOs Rajeev Sethi and Tore Johnsen, HRD head and director Sharif Ahmed, technical specialist Ahmed Manjur ud-daula, trustee board chairman (finance) Kazi Md Shahed, trustee board members Mainur Rahman Bhuiyan, Mainul Kader, and Manjur-ud-daula, and head of external communication, Sayed Talat Kamal.
The court then ordered the OC of EPZ police station to investigate the allegation. BTRC chairman Dr Shahjahan Mahmood had then told The Independent, “We will find out why the decision has not been implemented and take action.”
