A full bench of the Appellate Division of the Supreme Court will hear on July 25 an appeal filed by the government against the High Court order granting bail to BNP Acting Secretary General Mirza Fakhrul Islam Alamgir in three cases filed over vandalism and arson.
The chamber judge of the Appellate Division Justice Hassan Foyez Siddiqui, after a brief hearing yesterday on an appeal filed by the government against the High Court (HC) order, sent the matter to the full bench of the apex court.
Earlier on Sunday, the HC bench of Justice Md Rezaul Haque and Justice Md Khasruzzaman granted bail to Fakhrul in three cases. The HC also issued separate rules asking the government to explain, in four weeks, why the BNP leader should not be granted regular bail in the three cases.
A day after of the HC order, Attorney General Mahbubey Alam moved to the apex court seeking cancellation of the HC order. But the chamber judge passed ‘no order’, which means the HC order is now upheld, Barrister Mahbub Uddin Khokon, who represented Fakhrul at the chamber court, told reporters.
The law enforcers, on January 4 and 6, filed three separate cases against Mirza Fakhrul with Paltan Police Station for ordering, abetting and instigating unidentified party men to blast several crude bombs, vandalise five buses and a police motorbike and set them on fire at seven places in the capital on the eve of January 5, the first anniversary of the ‘controversial’ 10th national polls.
